Site Steering may prohibit any Participant or potential Participant from participating in the Direct Contact Feature, if at the sole discretion of Site Steering, such Participant shows a disregard for this Notice, or acts (1) with an intent to annoy, abuse, threaten, or harass any other Participant, SiteSteering.com and SiteSteering.net, or it agents or representatives; or (2) in any other disruptive manner. All issues and questions concerning the construction, validity, interpretation and enforceability of this Notice, or the rights and obligations of the Participant and in connection with the Direct Contact Feature, shall be governed by and construed in accordance with the laws of Texas without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of Texas.

Site Steering defines SPAM as one or more commercial or noncommercial unsolicited email, SMS/MMS text, or voice messages sent, or attempted to be sent, to anyone.
The penalties for sending unsolicited email, SMS/MMS text, or voice (“SPAM”) messages are potentially massive. Site Steering has developed the following “Spam Policy” to protect our Clients from unnecessary disruptions of service, and this “Spam Policy” is incorporated into the Site Steering Terms of Service.
Site Steering prohibits the use of its autoresponder service in any manner associated with the transmission, distribution or delivery of any unsolicited commercial or unsolicited non-commercial email, SMS/MMS text, or voice message, also known as Spam. You may not use any Site Steering service to send Spam. You may not deliver Spam, or cause Spam to be delivered to any of Site Steering’s services, subscribers, customers or subscribers of customers.
Email, SMS/MMS text, or voice messages sent, or caused to be sent, to or through the Site Steering autoresponder system may not use any means of deceptive addressing, including but not limited to invalid or forged headers, invalid or non-existent domain names, invalid or misleading phone numbers or keywords, employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path, or any other means of deceptive addressing.
Email, SMS/MMS text, or voice messages sent, or caused to be sent, to or through the Site Steering autoresponder system may not use a third party’s internet domain name, or be relayed from or through a third party’s equipment, or contain false or misleading information in the subject line or otherwise contain false or misleading information in the email, SMS/MMS text, or voice message body.
Site Steering prohibits, without exception, the import of any subscriber list that you obtained through a third party. This includes so-called “opt-in,” “business opportunity,” or any list that you did not directly create and obtain permission to send email, SMS/MMS text, or voice messages to the recipient. You may not import email, SMS/MMS text, cell phone, or land-line phone number lists that have been rented, leased, loaned, borrowed, or purchased. Any email address, cell phone, or land-line phone number, or list of email addresses, cell phones, or land-line phone numbers that you enter directly through your control panel will automatically be sent a message to inform the recipient that they have been added to your list. You can set up this feature through your control panel, and you can create or edit the content of this message. A system default message will be sent in the event that you choose not to create your own message. While Site Steering is Internet and direct marketing friendly, it is important to understand that violation of our Spam Policies will not be tolerated, regardless of reason or excuse. If you violate the Site Steering Spam Policy and send Spam email, SMS/MMS text, or voice messages, even if Site Steering services were not directly used (i.e. the Spam contains links or any information that could lead the recipient to Site Steering services), you will:

1) If you are not 100% satisfied with your Bronze Account Direct Contact Control Center service purchase within the first 30 days, we will be happy to provide a full refund of the Bronze Account plan, no questions asked. Additional credit purchases and/or additional services are not included in this portion of our refund policy, including, but not limited to account upgrades. VERY IMPORTANT – The 30 day 100% satisfaction guarantee applies only to the Bronze Account. If you feel that there is a chance that the Site Steering Direct Contact Control Center service may not work out for you, you should test the service only with the Bronze Account in order to qualify for the 100% satisfaction guarantee. From time to time, Site Steering may offer other account types that qualify for the 100% satisfaction/refund guarantee, and will be noted specifically with the guarantee/refund policy on the web pages and/or promotional materials describing the account plan. All refund requests must be received in writing prior to 30 days from the start of your Site Steering Direct Contact Control Center qualified account service. Regular mail, email and fax notifications are acceptable. Phone requests will not constitute acceptance of notice of any cancellation or refund request. If you do not receive a confirmation from us that we have received your refund request it means that we have not received it. Please contact us to verify that we have received your refund request. Refund requests received after 30 days from opening your qualified account will not be honored, and your account cancellation will be processed as described in section 3 of this Refund Policy. Refunds will only be made to the same credit card or PayPal account that is used for your monthly billing account.
2) If you cancel your Site Steering Direct Contact Control Center monthly billing account at any time during the first 30 days, your account will terminate at the end of the current monthly billing period, and no refund will be due (except for Bronze Accounts and specifically designated qualified accounts).
3) If you cancel your Site Steering Direct Contact Control Center monthly billing account at any time after the first 30 days, your account will terminate at the end of the current monthly billing period, and no refund will be due.
4) If you cancel your Site Steering Direct Contact Control Center monthly billing account at any time, your account will terminate at the end of the current monthly billing period, and no refund will be due (except for Bronze Accounts and specifically designated qualified accounts). All Additional Message Credit packages purchased to add additional message credits to your account will also terminate at the end of the current monthly billing period (upon account closure or cancellation, and no refund will be due on any remaining message credits in your account. DO NOT purchase more message credits than you can reasonably expect to use within a reasonable amount of time. This refund policy may or may not apply to any other additional or custom services, that may be offered from time to time, as any additional or custom service will include its own refund/return policy.
It is your responsibility to review this entire Refund Policy and the promotional pages associated with account types to determine the exact Refund Policy that applies to each account type prior to purchasing.
If any provision of these Terms of Service is held invalid or unenforceable in any respect by any court with jurisdiction over the parties, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions of these Terms of Service shall continue in full force and effect. No waiver of any provision of these Terms of Service shall be deemed a further or continuing waiver of such provision or any other provision of these Terms of Service.
These Terms of Service shall be governed by and construed in accordance with the Federal laws of the United States of America and the laws of the State of Texas, without regard to conflict of law provisions thereto. The parties consent to the exclusive jurisdiction of the courts of, and venue and situs in, Dallas County, Texas, USA.
